Considering the provisions of the Law on Electricity of the Federation of BiH (“Official Gazette of the Federation of BiH” No. 60/23), as of May 2024, the Electricity Distribution Division of JP “Elektroprivreda HZ HB” d.d. Mostar, in its role as the distribution system operator, is responsible for issuing Decisions on the Acquisition of the Status of Qualified Producer for production facilities that generate electricity from renewable sources and are not required to hold a license for electricity production according to the law governing the electricity sector in the Federation of Bosnia and Herzegovina, specifically those with an installed capacity of less than 1 MW.

A qualified electricity producer is defined as a producer who uses renewable energy sources in a specific electricity production facility and has obtained this status in accordance with the provisions of the Regulation on the Acquisition of the Status of Qualified Producer (“Official Gazette of the Federation of BiH” No. 30/24), adopted by the Regulatory Commission for Energy in the Federation of BiH (FERK).

The process for acquiring, renewing, transferring, and revoking the status of a qualified producer is initiated by the applicant using a specifically prescribed form, which must be submitted for each production facility individually:

• Application for acquiring/renewing the status of a qualified producer
• Application for transferring the status of a qualified producer
• Application for revoking the status of a qualified producer

Along with the application mentioned in point 1, the applicant must submit the following documents (in original or certified copies not older than 60 days):

• Current extract from the court register of the competent court for commercial companies and cooperatives, or registration document for associations and foundations
• Identification card for individuals
• Electrical energy consent for the producer issued by the relevant distribution system operator, or a connection approval from the relevant transmission system operator, depending on the location of the electricity production facility
• Approval for the use of the electricity production facility (with a final clause)
• Water permit (with a final clause) where required
• Environmental permit or decision on the preliminary environmental impact assessment (with a final clause) where required
• Project of the actual condition of the electricity production facility, or the main project if there have been no changes (in electronic form)
• Proof of payment of the one-time application processing fee

The completed application form for acquiring the status of a qualified producer, along with the accompanying documentation, must be certified and signed by the applicant or their legal representative or authorized agent. The application is considered complete when the form is fully and clearly filled out and the one-time application processing fee has been paid.
